The short version: Act 1 of BOOM! Circus Knockdown is free to play, and stays free. Big Top Pass is an optional subscription that opens the later acts, the endless encores and every obstacle we add. It is bought and cancelled through the App Store or Google Play, and it renews automatically until you cancel.
Who we are
BOOM! Circus Knockdown (the “App”) is a circus cannon physics game developed and published by Eximsol Sp. z o.o. (operating as UpFlyDev), Marszalkowska 115/338, 00-102 Warsaw, Poland. These Terms of Use (the “Terms”) apply to your use of the App on Apple’s App Store and on Google Play.
By downloading or using the App you agree to these Terms. If you do not agree with them, please do not use the App.
Your licence to use the App
We grant you a personal, non-exclusive, non-transferable licence to use the App on devices you own or control, for your own private, non-commercial use. You may not copy, sell, rent, reverse-engineer or redistribute the App or any part of it, except where that right cannot be restricted by law.
The App, its artwork, its sounds and its stages remain our property or that of our licensors. Openly licensed materials used in the App, such as its menu music, are credited in the App itself.
The free game
Act 1 and its 16 stages are free and stay free. Big Top Pass adds to the App; it never takes away a stage or a feature of Act 1.
The Big Top Pass subscription
Big Top Pass is an optional auto-renewable subscription, offered as a yearly and a monthly plan. While it is active it opens the acts after Act 1, the endless encores and the obstacles we add over time, as described on the Big Top Pass screen inside the App. The pass is access for as long as it is held; it is not a permanent purchase.
Price and period. The price and the billing period of each plan are shown in the App before you subscribe, in your own currency, as supplied by the app store you use.
Free trial. Where a plan offers a free trial, the App says so before you subscribe. The trial is available once per Apple Account or Google Account. Unless you cancel before the trial ends (on the App Store, at least 24 hours before), the subscription begins and your account is charged at the plan’s price.
Automatic renewal. Payment is charged to your Apple Account or Google Play account when you confirm the purchase. The subscription renews automatically at the end of each period, and your account is charged for the next period, until you cancel. On the App Store the charge comes within 24 hours before the period ends, unless you cancel at least 24 hours before the end of the current period.
Cancelling. You can cancel at any time in your Apple Account subscription settings or in Google Play under Payments & subscriptions, depending on where you subscribed. Cancelling stops future renewals; the pass stays active until the end of the period you have already paid for. We cannot cancel a subscription on your behalf.
When it ends. When the pass ends, the acts after Act 1 lock again and the free game continues as before. Your progress, including stages cleared while the pass was active, is kept, and renewing opens everything where you left off.
Payment, and who takes it
All payments are processed by Apple or by Google, depending on where you subscribed. We never see, receive or store your payment details. Your subscription is managed through your Apple Account or Google Account, and your purchase history there is the record of it. Apple and Google provide parental controls and purchase approvals for purchases made on a child’s device.
Refunds
Refunds are handled by Apple or Google under their own policies, and we have no ability to issue one directly. Requests can be made through Apple’s Report a Problem page or through your Google Play order history. If you are in the EU or the UK, your statutory rights are unaffected by this paragraph.
Changes to the price
We may change the price of Big Top Pass for new subscriptions at any time. Any change affecting an existing subscription will be made only in accordance with the rules of the app store you subscribed through, which include advance notice and, where required, your explicit agreement before the new price is charged. If you do not agree to a new price, you can cancel before it takes effect.
Changes to the App
We may add to, change or improve the App over time, including what Big Top Pass contains. We will not remove content from the free game.
Privacy
BOOM! Circus Knockdown collects no personal data in the App. Our Privacy Policy explains this in full and forms part of these Terms.
No warranty, and our liability
The App is provided “as is”. We work hard to keep it accurate, safe and enjoyable, but we cannot promise that it will always be free of errors or available without interruption.
To the fullest extent permitted by law, our total liability to you in connection with the App is limited to the amount you have paid for it in the twelve months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.
Governing law
These Terms are governed by the law of Poland. If you are a consumer resident in the European Union, you also keep the protection of the mandatory consumer law of the country you live in, and you may bring proceedings there.
Apple and Google
These Terms are between you and Eximsol Sp. z o.o., not with Apple or Google. Apple and Google are not responsible for the App or its content, and are not responsible for providing support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Changes to these Terms
If we change these Terms we will update this page and revise the “Last updated” date above. Meaningful changes will appear here before they take effect in the App.
